Can the State
Control Your Church?
Many states
have adopted the Model Nonprofit Corporation
Act. This act governs many of the aspects of
the corporation’s existence unless they are
specifically stated in your constitution and
bylaws. Not having bylaws or having
deficient bylaws may place the control of
certain aspects of your church in the hands
of the state and the courts. Because of
these state regulations, a church must use
caution to ensure that the bylaws contain
the latest provisions needed and in
accordance with the latest changes of the
