What Every Pastor Should Know About Church Lawsuits

By Raul Rivera

It’s not a topic any of us enjoys talking about. But the truth is, in today’s world, church lawsuits are more common than we might think—and they’re almost always unexpected.

Over the years, I’ve had the privilege of walking alongside pastors and ministry leaders through some of the most inspiring moments of their ministry. But I’ve also walked with some through difficult, painful seasons, especially when legal challenges come against the very church they’ve poured their lives into building.

What I’ve learned is this: no one plans to be sued. But every church can take steps to be prepared.

The Top 5 Reasons Churches End Up in Court

These aren’t hypotheticals. They’re the real issues that land churches in courtrooms across the country.

1. Employment-Related Lawsuits

This is the number one cause of church litigation. Churches can face claims of wrongful termination, discrimination (based on race, sex, age, or disability), harassment, retaliation, or wage and hour violations.

Many churches operate like a family and avoid formal HR processes, but courts don’t make exceptions for ministries. Written policies, job descriptions, and consistent practices are critical.

2. Sexual Abuse and Misconduct Allegations

Allegations, proven or not, can be legally and emotionally devastating. Churches often fail to implement background checks, screen volunteers properly, establish strong child safety protocols, or respond to complaints with clarity and care.

Even if the church is eventually cleared, the damage to trust, reputation, and finances can be long-lasting.

3. Property Disputes

Churches often face legal conflict over property ownership, zoning restrictions, lease disagreements, or poorly written construction contracts. These issues usually stem from unclear documentation or verbal agreements.

Assumptions and handshake agreements can quickly turn into lawsuits. Proper documentation and clear records are essential.

4. Personal Injury on Church Premises

These claims often involve slip-and-fall accidents, injuries during events, or mishaps in parking lots. Even with good intentions, churches can be held liable if proper safety protocols aren’t followed.

Courts don’t require bad intent, just proof of negligence. If you host people, you must have protocols and insurance to match.

5. Internal Church Conflicts and Governance Breakdowns

Sadly, some lawsuits are brought by church members or even former leaders. These often stem from leadership disputes, financial disagreements, unclear pastoral transitions, or bylaws that are outdated or not followed.

When conflict arises, courts look at your governing documents. If your bylaws aren’t clear or you aren’t following them, you’re at risk.

What’s Really at Stake

When a church faces a lawsuit, it’s not just the legal expenses or court dates that cause stress. The deeper damage is often relational and spiritual. Church unity is tested. Leadership integrity may be questioned. The mission slows down or even stops.

And if the church isn’t set up properly, the personal assets of the pastor or board members could even be at risk.

That’s why the best time to prepare is before anything goes wrong.

How to Protect Your Church

Here are five proactive steps you can take now:

  1. Review and follow your bylaws. Ensure they reflect how your church actually operates and update them as needed.
  2. Formalize your board and meetings. Keep minutes, document decisions, and stick to approved processes.
  3. Establish clear HR practices. Written policies, signed agreements, and background checks should be standard.
  4. Audit your insurance. Make sure your policies reflect real-life risks, including D&O, general liability, and abuse coverage.
  5. Maintain legal standing. Don’t let your incorporation or IRS status lapse. Keep your records current.

A Final Word of Encouragement

Starting right on a solid legal foundation is one of the best ways to protect your church. But even if your church didn’t start right, it can still get right. Legal clarity and protection aren’t just for new churches; they’re available to every church that’s ready to take the next step.
If this feels overwhelming, you’re not alone. You’re also not behind. Taking even one of these steps is a win.

At StartCHURCH, we’ve helped thousands of churches strengthen their legal foundation and walk in wisdom. If you’re unsure where to begin, reach out. That’s what we’re here for.

Your calling is too important and your church’s mission too valuable to leave unprotected.
